This Privacy Policy does not apply to third party services, websites, or applications that we may link to through the website. When you use one of these links to leave our website, we encourage you to review the privacy policies that apply to the services, websites, or applications you choose to access.

Certain parts of our platform are made available to clients who have paid for premium services and/or formally engaged a mediator, a therapist for services outside of our scope. They may be subject to additional terms and conditions, as well as additional privacy and data security provisions. In such cases, both this Privacy Policy and the additional terms will apply.

Except as permitted by law or as otherwise described below, Split Happy does not disclose any NPI about its customers, or former customers, its independent contractors (including Mediators and Therapist), or employees, to anyone. Split Happy does not sell lists or customer information.

Information Split Happy Collects for Customers

Split Happy collects, retains, and uses NPI from customers to include the following:

  • The information that is required when you sign up for the Website, as well as the information you choose to share.
  • The information that is required to pre-fill Court forms and complete other documents on your behalf.
  • Required information such as your name, email address, birthday, and gender.

We use return email addresses to answer the email we receive. We may also use the physical and email addresses we collect online only to send you information about our services, product announcements, changes to our terms and conditions, events, or publications. Such addresses are not used for any other purpose and are not shared with outside parties.

  • Usernames and Passwords, which are a way to identify you on Split Happy. Password is a combination of letter, numbers, and/or symbols created by you on our system and a username is a combination of letters created by you on our system.
  • "Public Information", which means the information you choose to make public, as well as information that is always publicly available.
  • "Personal Non-public Information", which means any information, which is not public information and which is personal to you, your spouse, or a member of your immediate family.
  • Information posted to a group chat or mediation session and information kept within a one on one mediation session, also known as a caucus.
  • “Contact Information” is personal information and or family/friend/relation that Split Happy stores confidentially for your Mediator and Therapist to access in case of an emergency.
  • Information Split Happy receives on forms, including, but not limited to, identifying information such as address(es), telephone number(s), date(s) of birth, e-mail address(es);
  • Banking and/or credit card information for billing purposes; such as account numbers and other data used for invoicing purposes.

Unless specified otherwise, all data requested on our Website to pre-fill Court forms and complete other documents on your behalf or for other services is mandatory and failure to provide this data may make it impossible for us to provide our services. In cases where the Platform specifically states that some data is not mandatory, Users are free not to communicate this data without consequences to the availability or the functioning of the Service.

Users are responsible for any third-party personal data obtained, published or shared through the Platform and confirm that they have the third party’s consent to provide their data to Split Happy.

Information Split Happy Collects for Employees and Independent Contractors, including Mediators and Therapists.

Federal law requires us to obtain, verify, and record personal information - such as your name, address and date of birth - in order to confirm your identity, social security number and banking information.

Split Happy collects, retains, and uses NPI from employees and independent contractors including the following:

  • Federal Tax ID numbers;
  • Background security checks.

Information Split Happy May Share

Split Happy Inc., is a corporation organized under the laws of the State of Delaware and it runs the site and keeps data, along with its service providers. We keep your information confidential except where disclosure is required or permitted by law. Generally, we only use your information within our company. However, sometimes we use third parties to process your information (for example as credit card payment providers). We require these third parties to comply strictly with its instructions and we require that they not use your personal information for their own business purposes.

The Uses of the Collected Data by Split Happy

The majority of the data collected by Split Happy or on www.splithappy.com is used to service your account and provide content for the court forms to be generated for you in your separation and divorce journey. The remaining data collected is to facilitate selection and use of Mediators and Therapists by those wishing to use this additional service.

Split Happy uses non-identifying and aggregate information to better design our Website and to use in research and trend analysis. For example, we may tell an advertiser that X number of individuals visited a certain area on our Website, or that Y number of men and Z number of women filled out a site survey or form, but we would not disclose anything that could be used to identify those individuals. We only provide data to our partners, if any, after we have removed your name and any other personally identifying information from it, or have combined it with other people's data in a way that it no longer personally identifies you.

The User is responsible for his or her own settings on any computer used to access our Website, and the User is thus responsible for determining whether information is transmitted from his or her device to Split Happy through any means. Computer data containing no personally identifiable information will be used only for internal business purposes.

Split Happy uses non-identifying (De-Identified or “Safe Harbor” form) and aggregate information about responses to the clinical outcome assessments (personal assessments), and the frequency of the utilization of the Split Happy service. These efforts enhance program evaluation.

The anonymous and aggregated data also may be published through various media platforms/academic journals. No personal identifying information is tied to the results, and Split Happy does not share anything that could be used to identify your account or your private information.

From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future, we will contact you before we use your data for these new purposes to notify you of the policy change and to provide you with the ability to opt out of these new uses.

  • To independent auditors or consultants in order to carry out institutional risk control;
  • To government or regulatory agencies, including self-regulatory organizations and to comply with a legal summons, court order, subpoena or a similar legal process, audit or investigation;
  • To swap data repositories.

In some cases, the data may be accessible to certain types of persons in charge, involved with the operation of the Platform (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as data processors.

The Split Happy Platform is available on a multitude of portable electronic devices. We provide our connection to mobile services for free, but please be aware that your carrier's normal rates and fees, such as text messaging fees, may still apply. You provide all rights necessary to enable Split Happy Users to sync (including through an application) their contact lists with any basic information and contact information that is visible to them on www.splithappy.com, as well as your name and profile picture (if any).

California Consumer Privacy Act (CCPA) Use And Disclosure Of Personal Data

Split Happy is not responsible for data lost/exposed/used due to the nature of the Internet and digital environments, including illegal actions of hackers and criminals, technical malfunctions of servers and database etc. These are the accepted risks of our Users and users of the Internet in general. You are agreeing to this standard in using our Website.

Split Happy reserves the right to amend this Privacy Policy at any time without notice, and only the current Privacy Policy may be deemed effective. Regardless of later updates or changes to our privacy notice, we will never use the information you submit under our current privacy notice in a new way without first providing you an opportunity to opt-out or otherwise prevent that use by notifying you on our Website and possibly within the Platform and/or – as far as technically and legally feasible – sending a notice to you via any contact information available to Split Happy.
